TERMS AND CONDITIONS

  1. USERS: Access to and/or use of this Rodabell, S.A. portal confers the status of USER, who accepts, from such access and/or use, the General Terms of Use set out herein.
  2. USE OF THE PORTAL: rodabell.com provides access to a wide range of information, data and photographs (hereinafter, “the content”) on the Internet belonging to Rodabell, S.A. The USER assumes responsibility for use of the portal. The USER undertakes to make appropriate use of the content and services (such as, for example, chat services, discussion forums or newsgroups that may be created within the portal) that Rodabell, S.A. offers through its portal and, by way of example but not limitation, not to use them to (i) engage in unlawful, illegal activities or activities contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, illegal pornographic nature, that advocates terrorism, or that infringes human rights; (iii) cause damage to the physical and logical systems of Rodabell, S.A., its suppliers or third parties; introduce or disseminate computer viruses on the network or any other physical or logical systems that may cause the aforementioned damage; (iv) attempt to access and, where applicable, use other users’ email accounts and modify or manipulate their messages. Rodabell, S.A. reserves the right to remove any comments and contributions that violate respect for human dignity, that are discriminatory, xenophobic, racist or pornographic, that threaten youth or children, public order or public safety, or that, in its opinion, are not suitable for publication. In any event, Rodabell, S.A. shall not be responsible for opinions expressed by users through forums, chats or other participation tools that may be created within the corporate web portal, as well as on Rodabell, S.A.’s official social media profiles.
  3. DATA PROTECTION: Rodabell, S.A. complies with the guidelines and obligations set out in REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with other data protection legislation in force at any given time, and ensures the proper use and processing of personal data used in its information systems, as well as their confidentiality, integrity, availability and resilience at all times.

INTELLECTUAL AND INDUSTRIAL PROPERTY: Rodabell, S.A., either in its own right or as assignee, holds all intellectual and industrial property rights to its website, as well as to the elements contained therein (by way of example, images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by Rodabell, S.A. or by its licensors. All rights reserved. Pursuant to the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including making available, of all or part of the content of this website, for commercial purposes, on any medium and by any technical means, are expressly prohibited without the authorisation of Rodabell, S.A. The USER undertakes to respect the Intellectual and Industrial Property rights owned by Rodabell, S.A. The USER may view the elements of the portal and even print, copy and store them on their computer’s hard drive or on any other physical medium, provided that this is solely and exclusively for their personal and private use. The USER must refrain from deleting, altering, circumventing or manipulating any protection device or security system installed on Rodabell, S.A. pages.
  5. DISCLAIMER OF WARRANTIES AND LIABILITY: Rodabell, S.A. shall not be liable, in any case, for damages of any kind that may be caused, by way of example: errors or omissions in the content, lack of availability of the portal, or the transmission of viruses or malicious or harmful programs in the content, despite having adopted all necessary technological measures to prevent this.
  6. MODIFICATIONS: Rodabell, S.A. reserves the right to make, without prior notice, any modifications it deems appropriate to its portal, and may change, delete or add both the content and services provided through it, as well as the way in which they are presented or located on its portal.
  7. LINKS: In the event that www.rodabell.com includes links or hyperlinks to other Internet sites, Rodabell, S.A. shall not exercise any control over such sites and content. In no event shall Rodabell, S.A. assume any liability for the content of any link belonging to a third-party website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, truthfulness, validity or constitutionality of any material or information contained in any such hyperlinks or other Internet sites. Likewise, the inclusion of these external connections shall not imply any association, merger or participation with the connected entities.
  8. RIGHT OF EXCLUSION: Rodabell, S.A. reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, on its own initiative or at the request of a third party, to those users who breach these General Terms of Use.
  9. GENERAL: Rodabell, S.A. will pursue any breach of these terms, as well as any improper use of its portal, by exercising all civil and criminal actions to which it may be entitled under law.
  10. AMENDMENT OF THESE TERMS AND DURATION: Rodabell, S.A. may amend the terms set out herein at any time, and they will be duly published as they appear here. The validity of these terms will depend on their publication and they will remain in force until they are amended by others duly published.
  11. APPLICABLE LAW AND JURISDICTION: The relationship between Rodabell, S.A. and the USER shall be governed by current Spanish law, and any dispute shall be submitted to the Courts and Tribunals of Vivero.
